I. General provisions

1. Definitions:

The definitions used in these regulations should be interpreted as follows:

Customer - a retail customer or a legal person who has correctly registered in the store www.andypolishpottery.com by creating an account and successfully placed an order to purchase the product;

Provisions of law Act of 23 April 1964. Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended); Act of 27 July 2002 on special terms and conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended); Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (Journal of Laws of 2000, No. 22, item 271, as amended), the Personal Data Protection Act of August 29, 1997 (consolidated text: Journal U. of 2002, No. 101, item 926, as amended).

2. Information on Products

All Products offered in the Store are new, manufactured by ANDY HAND PAINTED POLISH POTTERY EKSPORT-IMPORT Andrzej Potocki Tomaszów Bolesławiecki 111 A, 59-720 Raciborowice Górne, POLAND. VAT NO. PL 694-135-78-55, based on the original designs of cooperating artists and are protected by copyright. The products are made according to the traditional technology of Bolesławiec pottery production and hand-decorated with natural dyes, based on the company's original designs.

Due to the manual way of making ceramic patterns and their hand-made decoration, the Seller reserves the possibility of slight differences in the decoration of the Products offered within a given series and the existence of slight differences between individual copies of a given pattern (i.e. shades, shapes, sizes, arrangement - decorations and shapes).

The seller may temporarily organize promotional campaigns understood as offering the sale of products on terms more favorable than standard;

Promotions in force in the store do not combine with other promotions, unless the regulations of a given promotion state otherwise.

3. Prices

All prices of Products offered by the Store are given in Polish zlotych.

The prices given are gross prices (including VAT).

Product prices do not include shipping costs.

The Seller reserves the right to change the prices of the Products in the Store's offer, as well as the right to organize (carry out, modify and cancel) promotional campaigns in the Store, with the proviso that the price accepted by the Customer when placing the order is the price binding for both parties to the sales contract.

4. Promotions

The seller may temporarily organize promotional campaigns understood as offering the sale of products on terms more favorable than standard;

Promotions in the store do not combine with other promotions, unless the regulations of a given promotion state otherwise.

 

II. Registration and logging in to the store andypolishpottery.com

Purchases at andypolishpottery.com can only be made by registered users or users who have not registered an account.

By registering in the Store is understood as setting up your own account.

Registration takes place by correctly filling in the registration form, defining your login and account password.

A link confirming the creation of an account will be sent to the e-mail address provided in the registration form.

Registration in the Store is tantamount to acceptance of these regulations.

 

III. Orders and sales contract

The Seller sells Products in the Store using the Internet.

The information contained in the Store regarding the Products does not constitute offers within the meaning of the Civil Code, they should be treated only as an invitation to conclude a sales contract.

In order to purchase the Product, the Customer submits an offer to purchase it by completing the order form.

The contract for the sale of the Product is considered to be concluded on the day the Seller sends an e-mail to the Customer's internet address confirming the fact of sending the ordered Product.

After placing the order by the Customer, the Seller will send an e-mail to the e-mail address provided in the registration form containing the confirmation of the order being processed and the information on sending the Product to the Customer.

 

IV. Order processing, change, order withdrawal.

Orders placed in the Store are carried out as standard in the Republic of Poland, the European Union and other countries of the world.

The implementation of foreign orders is possible in individual cases and requires separate arrangements between the Store and the Customer.

Orders paid by bank transfer, e-transfer or credit card are processed within 18 days from the moment the order amount is credited to the Store's account.

Orders are processed on business days, between 7.00 a.m. and 3.00 p.m. Orders placed after 15 are accepted on the next business day and implemented depending on the chosen form of payment.

The order fulfillment dates listed in this chapter apply to goods currently available in the Store. The seller reserves that the implementation of orders for products currently unavailable in warehouses may exceed the above-mentioned deadlines.

In such a situation, the Customer will be notified in the e-mail confirming the acceptance of the order for execution about the extension of the order completion date. If within two working days from the date of notification, he does not withdraw from the order, the Seller will assume that the Customer agrees to extend the order fulfillment time.

Changes to the order placed are allowed until the Seller sends an e-mail confirming the acceptance of the order.

Until then, the customer also has the option to withdraw his order.

The seller allows you to use the following forms of shipment of the order: courier company, personal pickup.

Shipping costs depend on the chosen form of delivery. Their amount is calculated in the summary of the list of selected purchases depending on the selected delivery method and payment method. a) Delivery costs in the territory of the Republic of Poland.

We reserve the right to change shipping costs and delivery times due to constant changes in carrier prices and delivery times.

We make every effort to ensure that the parcel is complete, undamaged and within the time specified. We are aware of the current conditions, the time of order fulfillment may change as well as the availability of products. The products offered in the store www.andyceramika.pl have a characteristic and specific method of production - we reserve the right to change and cancel the order in the event of production shortages, random and health events, elements and not provided for by us.

Payment by bank transfer to the store's account should be received within 3 working days from the moment of order confirmation, otherwise the order will be canceled.

Payment methods available:

If there is a need to return funds for a transaction made by the customer with a payment card, the seller will be returned to the bank account assigned to the payment card of the Ordering Party.

The order processing time is counted: If the Customer chooses the method of payment by bank transfer, electronic payment or credit card - from the date of crediting the bank account Sellcy.

VI. Proofs of purchase and sales contract confirmations

Each customer of www.andypolishpottery.com receives a proof of purchase in the form of a receipt or "on request" a VAT invoice.

Customers who want to receive a VAT invoice should mark this fact at the time of placing the order by selecting the appropriate option in the order form and providing all the required data.

The customer whose order exceeds the price of PLN 2,000 will receive from the seller a written confirmation of all essential provisions of the concluded sales contract (in accordance with Article 2.2 of the Act of 27 July 2002 on special terms of consumer sales). The customer will receive this confirmation along with the purchased product.

 

VII. Damage to shipments

The Seller will make every effort to ensure that the ordered goods are adequately protected against damage during delivery, however, the Customer is obliged to check the condition of the packaging upon receipt of the shipment.

If the packaging of the parcel has signs of damage (destruction of the packaging, crushing, tearing off the safety tapes) or has traces indicating the possibility of its opening during transport, the customer should not pick up the parcel, but prepare a damage report in the presence of the deliverer and notify the Store about this fact. Otherwise, the Seller will assume that the product was delivered in a non-defective package.

Failure to check the shipment upon delivery will result in the Seller not taking into account any claims for damage to the shipment or theft of all or part of the shipped products.

Acceptance of the shipment by the Customer, despite its visible damage, means that he will not be able to use his rights under the warranty and guarantee in a situation where the damage to the shipment resulted in mechanical damage to the product.

 

VIII. Withdrawal from the sales contract and return of the Product

Pursuant to Article 7 of the Act on the protection of certain consumer rights and liability for damage caused by a dangerous product, the Customer has the right to withdraw from the Product sales contract without giving any reasons within 14 days from the date of product delivery.

For this purpose, the Customer is obliged to submit an appropriate statement in writing and send it to the address of the Seller.

In the event of withdrawal from the sales contract, it is considered void, the Customer is obliged to return the Product intact (without signs of use, with complete content including the proof of sale, in the original packaging), and the Seller is obliged to refund the sale price of this Product.

The Product should be returned immediately after submitting the declaration of withdrawal from the contract of sale, not later than within 14 days from the date of submission of the declaration of withdrawal from the contract. In the statement, the Customer should provide the account number to which the Seller will refund the selling price of the product.

The Seller declares that he does not accept COD shipments.

The seller certifies the return of the product in writing.

 

IX. Complaints

The products are covered by a 12-month warranty. Detailed conditions for the implementation of the guarantee are specified in the regulations / contract issued by the guarantor. The goods should be sent at their own expense via a courier (shipping company)to the correspondence address provided on the store's website. The replaced product is sent back to the customer at the expense of the store / seller.

 

The store is liable for 2 years from the date of purchase in the event of non-compliance of the goods with the contract in accordance with Art. 10 of the Act on special conditions of consumer sales of July 27, 2002. The customer loses the rights specified in the above-mentioned act, if within two months of finding the non-compliance of the goods with the contract will not notify the store about this fact.

 

In the event of non-compliance of the goods with the contract, the advertised goods along with a description of the non-compliance and expectations regarding the implementation of our obligations, should be returned at your own expense via a courier (shipping company) to the correspondence address provided on the store's website, specifying how to fulfill the store's obligations. The customer has the right to demand that it be brought into line with the contract by free replacement. If the store is not able to meet specific requests, the customer has the right to demand an appropriate price reduction or may withdraw from the contract.

 

The store will respond to the customer's requests within 14 working days from the moment of reporting the non-compliance of the goods. If the case requires additional technical expertise performed by external companies or in the event of unforeseen random events, this period may be extended.

 

If the notification of non-compliance of the goods takes place within 10 working days from the moment of purchase, the Customer has the right to request the replacement of the product with a new one in an accelerated manner. The accelerated procedure applies only to a specific group of products. If the non-compliance is found and the advertised goods are available, the new goods will be shipped within a few working days from the delivery of the non-compliant goods to the store.

If not it is possible, the store will offer the buyer a refund of the product's price or propose another product available in the store with similar parameters.

 

In each of the above cases, when the implementation of the customer's requests involves the delivery of new goods, the cost of delivery to the customer is borne by the store.

 

Pursuant to the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (Journal of Laws No. 22, item 271), Art. 7, within 14 days from the delivery of the ordered goods, the consumer has the right to return it without giving reasons as part of withdrawal from the contract, according to the general principles resulting from the provisions on concluding distance contracts. In the event of withdrawal from the contract, the contract is considered void and the consumer is released from any obligations. The goods returned in this mode will be accepted only if they are returned unchanged, unless the change was necessary within the limits of ordinary management. This means that the goods must be in their original, undamaged packaging, with all its contents, and the product itself and accessories will be undamaged. It is permissible to open the packaging in order to see the goods, and the goods may be used, provided that such use will not lead to a change in its condition. Pursuant to the Act, the possibility of return does not apply to audio and visual recordings as well as computer programs stored on carriers after the consumer has removed their original packaging. If you wish to use the above-mentioned right of return, the goods should be returned at your own expense to the correspondence address provided on the store's website. Such a return shipment must be accompanied by a written declaration of withdrawal from the contract and the account number to which the store is to return the payment. The shop checks the product within 14 working days. If the goods meet the above-mentioned requirements, a corrective invoice is issued. The original and the copy are sent to the customer by registered mail. The customer should send back a signed copy of the correcting invoice, and after receiving it, the store will refund the money to the customer's account within 7 working days.

The warranty and withdrawal from the contract do not apply if the product is affected by mechanical damage of external origin. Therefore, before accepting the package, you should always check that the packaging has not been damaged in transit. In particular, pay attention to the condition of the tapes or seals attached to the package. If the package of the shipment is damaged or the seals / tapes are broken, do not accept the shipment and prepare a damage report in the presence of the courier and contact the seller as soon as possible to clarify the matter. Checking the parcel on delivery is a necessary condition to take into account any customer claims for damage or theft of the parcel during transport - a report of damage to the parcel drawn up with the courier upon collection of the parcel is necessary.

 

X. Final Provisions

Any comments and notifications regarding the functioning of the Store, violations of the Regulations, Product offer or other identified irregularities, all statements, complaints and other notifications addressed to the Seller, should be sent to the Seller's e-mail address.

The Seller reserves the right to make changes to the Regulations.

Amendments to the Regulations will be published on the store's website and enter into force on the date of publication.

In matters not covered by the Regulations, the provisions of law and other relevant provisions in force in the Republic of Poland shall apply.
